Terms and Conditions of Sale

These general terms and conditions of sale (hereinafter “T&Cs”) apply exclusively to the online sale of products by the company Poolstar, for the NETSPA brand, on the website www.shop.netspa.eu.

These T&Cs apply exclusively to products delivered to customers located in France and Europe, unless otherwise explicitly stated on a product page.

The T&Cs are made available to customers on this website, where they can be accessed directly. By ticking the appropriate box during the ordering process, the customer acknowledges having read and accepted the T&Cs without reservation.

Placing an order implies full and unconditional acceptance of these conditions by the customer.

1. Definitions

  • T&Cs: these general terms and conditions of sale.
  • Customer: any individual of legal age acting for non-professional purposes who orders one or more products via the website.
  • Order: purchase made through the website.
  • Product: any item available for sale on the website.
  • Website: www.shop.netspa.eu

2. Product Description

Each product is presented with a detailed description including its essential characteristics. This information is provided by the manufacturer. Slight differences may exist between the delivered product and the one shown on the website.

3. Prices

  • Prices are shown in euros including VAT, excluding shipping costs.
  • Shipping costs are displayed before the order is confirmed.
  • Promotional offers are valid while stocks last.
  • The seller reserves the right to change prices at any time. The applicable price is the one in effect at the time of the order.

4. Availability

Products are offered while stocks last. In case of unavailability, the customer will be notified by email and may modify the order or request a refund.

5. Ordering and Confirmation

The ordering process includes the following steps: add to cart, customer identification, choice of delivery and payment methods, order summary, final confirmation (double-click), and payment. A confirmation email is sent immediately after.

The customer acknowledges that final order validation constitutes a payment obligation.

6. Payment

Payment is required upon ordering. Accepted payment methods:

  • Credit card: Visa, Mastercard, CB, American Express
  • PayPal (including 4-installment payment if eligible)
  • Bank transfer

Payments are secured via SSL and 3D Secure. NETSPA never stores your bank details.

7. Delivery

Products are delivered in France and Europe via GLS, Kuehne + Nagel, or DB Schenker. An appointment is required for deliveries with Kuehne + Nagel and DB Schenker. Shipping time: 3 business days after payment is received. A tracking link will be provided.

8. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer has a 14-day right of withdrawal from the date of receipt of the product.

Returns must be requested via our contact form. Products must be returned in their original condition. Return costs are the responsibility of the customer.

Refunds will be processed within 14 days after the returned product is received.

9. Warranties

Products benefit from the legal warranty of conformity (2 years) and the warranty against hidden defects. In case of non-conformity, NETSPA will replace or refund the product.

10. Liability

NETSPA cannot be held liable for indirect or unforeseeable damages arising from the use of the site or the products. In cases of force majeure, the company is released from all liability.

11. Contract Archiving

In accordance with Article L213-1 of the French Consumer Code, orders exceeding €120 including VAT are archived for 10 years. The customer may access them upon request.

12. Governing Law and Dispute Resolution

These T&Cs are governed by French law. In case of a dispute, an amicable solution will be sought first. The customer may also contact a mediator or use the European online dispute resolution platform: ec.europa.eu/odr.
